ORDINANCE NO. 414 AN ORDINANCE of the Town Council of the Town of Brewster, Washington, providing for the submission to the qualified electors of the town at a special election to be held therein in conjunction with the primary election on Sep- tember 15, 1981, of the proposition of whether or not the town should issue its general obligation bends in the aggre- gate principal amount of $30,000 for the purpose of paying the cost of acquiring a backhoe. WHEREAS, it is deemed necessary and advisable by the Town Council of the Town of Brewster, that the Town acquire a backhoe and, in order to provide funds to pay the cost thereof, that the Town issue and sell Its general obligation .bonds in the aggregate principal amount of $30,000; and WHEREAS, the Constitution and laws of the State of Washington provide that the question of whether or not the Town may issue such bends for such purposes must be sub- ffdtted to the qualified electors of the Town for their ratification or rejection; + NOW, THEREFORE, BE IT ORDAINED by the Council of {he Town of Brewster, Washington, as follows: Section 1. FINDINGS. It is hereby found and declared that it is necessary for the public welfare and benefit of the inhabitants of the Town that the Town acquire a backhoe, complete with necessary and proper equipment. : Section 2. AUTHORIZATION OF BONDS. For the purpose of providing the funds to pay the cost of acqulr a backhoe, with all necessary and proper equipment, Indudlng all costs ;of financial, legal, and other  services lawfully incident : thereto and to the issuance of the bonds, the Town shall issue : and sell its general obligation bends In the aggregate prin. clpal amount of not to exceed $30,000. The bends shall be : issued in such amounts and at such time or thnes as deemed ; necessary and advisable by the Town Council and may be : issued in one or more series, shall bear interest at a rate of :not to exceed the max/mum rate permitted by law, and shall :mature serially in from two to six years from date of lzmue. .*Both principal of and interest on the bonds shall be payable by annual levies in excess of regular property tax levies to be ;made upon all the taxable property within the Town in such ;amounts as are sufficient, together with other legally :available funds, to pay such principal and interest as the ;Imme shall become due. The exact date, form, terms, options : redemption and maturities of the bends shall be as hereaf- ter fixed by ordinance of the Town. None of the proceeds of such bends shall be expended for replacement of equipment or for other than a capital purpose. Section 3. USEFUL LIFE OF IMPROVEMENT&amp; The useful life of the backhoe to be acquired by use of the proceeds of the bends is hereby found to be in exceu of six years. Seetlon 4. ELECTION C. It is hereby found and declared that an emergency exists requiring the submlasien to the qualified electors of the Town of the propotion of whether or not the Town shall bsue the bends for their ratification or rejection at a special election to be held in con. junction with the primary election on September 15,1981. The Okanogan County Auditor as ex-offlcio supervisor of elections is hereby requested also to find the exice of such emergency and to assume Jurladlctlen of and to call and conduct a special election to be held within the Town on such date and to submit to the qualified electors of the Town the propos/tion hereinafter set forth. The Town Clerk is hereby authorized and directed to certify the proposition to the Okanogan County Auditor in the following form: TOWN OF BREWSTER PROPOSITION NO. GENERAL OBLIGATION BONDS, 130,000 Shall the Town of Brewster, for the purpose of acquiring a backhoe, issue $30,000 of general obligation bends maturing serially in from two to six years and payable from annual property tax levies in excess of regular tax levies, all as more specifically provided in Ordinance No. 414? BONDS, YES ...... [] BONDS, NO ...... [] The Town Clerk is hereby authorized and directed to deliver a certified copy of this ordinance to the Okanogan County Auditor. The bends shall be issued in such amounts and at such time or times as deemed necessary and advisable by the Town Coun- cil and may be issued in one or more series, shall bear in- terest at a rate of not to exceed the maximum rate permitted by law, and shall mature serially in from two to six years from date of issue. Both principal of and interest on the bends shall be payable by annual levies in excess of regular proper- ty tax levies to be mode upon all the taxable property within the Town in such amounts as are sufficient, together with other legally available funds, to pay such principal and in- terest as the same shall become due. The exact date, form, terms, options of redemption and maturities of the bends shall be as hereafter fixed by ordinance of the town.
